By accessing or using Sand Swinger ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

Sand Swinger is a community platform that enables verified golfers to submit factual, event-based integrity reports about playing partners. The Service is designed to support South African golf communities in maintaining integrity standards.

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Be a registered golfer with a valid SA Player ID
• Have the legal capacity to enter into these Terms
• Not have been previously banned from the Service

4. Account Registration

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must not share your account credentials
• You must notify us immediately of any unauthorized access
• Verification of your golfer status may be required before submitting reports

5. Reporting Guidelines

When submitting integrity reports, you agree to the following:

5.1 Reports Must Be

• Factual: Based on events you personally witnessed
• Event-based: Tied to specific dates and locations
• Good faith: Submitted with genuine integrity concerns
• Accurate: Truthful to the best of your knowledge

5.2 Reports Must Not Contain

• Labels such as "sandbagger," "cheat," or "fraudster"
• Personal insults, speculation, or hearsay
• Information about rounds you did not personally witness
• False, misleading, or malicious information
• Content intended to harass or defame

5.3 Play Attestation

By submitting a report, you attest that you played with or directly witnessed the subject during the reported event. False attestations may result in account suspension or legal action.

6. Prohibited Conduct

You agree not to:

• Submit false, fraudulent, or malicious reports
• Harass, threaten, or intimidate other users
• Attempt to manipulate or circumvent verification systems
• Create multiple accounts to evade restrictions
• Use automated tools to access or scrape the Service
• Interfere with or disrupt the Service
• Violate any applicable laws or regulations
• Impersonate another person or entity
• Upload malicious code or harmful content

7. Content Ownership and License

7.1 Your Content

You retain ownership of content you submit. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process your content for operating the Service.

7.2 Our Content

The Service and its original content, features, and functionality are owned by Sand Swinger and are protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

8. Moderation and Enforcement

• Reports are reviewed by authorized moderators for compliance
• We may remove or modify content that violates these Terms
• We may suspend or terminate accounts for violations
• Decisions may be appealed through our dispute process
• Serious violations may be reported to golf authorities or law enforcement

9. Subject Rights

Golfers who are the subject of reports have the right to:

• Be informed that a report exists about them
• Access non-identifying information about reports
• Dispute inaccurate or unfair reports
• Request correction or deletion of personal information
• Appeal moderation decisions

To the maximum extent permitted by law, Sand Swinger and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use or inability to use the Service
• Content or reports submitted by other users
• Unauthorized access to your account or data
• Any errors, mistakes, or inaccuracies in content
• Any interruption or cessation of the Service

12. Indemnification

You agree to indemnify and hold harmless Sand Swinger from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your violation of any third party rights
• Content you submit to the Service
• Your use or misuse of the Service

13. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data
• Provisions that should survive termination will remain in effect

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

15. Dispute Resolution

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us. If a dispute cannot be resolved informally within 30 days, either party may pursue formal resolution through the courts of South Africa.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Reporting Rules, constitute the entire agreement between you and Sand Swinger regarding use of the Service.
